A law reporter should study a case thoroughly before reporting it. The facts section of a case report should be a summary of the facts. To summarize, one must understand. The law reporter’s failure or inability to summarize the facts suggests that the law reporter never understood the case. Facts sections of law reports should be under 500 words in length. Typically, a facts section should occupy just one page of the report. It should be an easily understood story, not a gallimaufry of data and dates.

The law reporter quotes a party’s issues for determination, which occupy about one and a half pages. It also quotes constitutional provisions and court rules. Facts sections should not quote issues or legal rules. To include issues or rules, summarize them in a few short sentences. Again, the extensive quotations (from the parties’ documents, the Constitution, and court rules) expose the law reporter’s lack of understanding of the case it reports.

This is a facile approach to law reporting. Law reporters must be diligent legal researchers who scrutinize beforehand every case they report.

[202
206,207,208,209,130,98,210
post-1888","post","type-post","status-publish","format-standard","hentry","category-the-write-partner-july-2015-edition","tag-elegance-in-writing","tag-judgments","tag-law-reporting","tag-law-reproters","tag-legal-writing","tag-the-write-house","tag-writing
["GET
