In Donoghue v Stevenson, Mrs Donoghue went to a café with her friend. The friend bought Donoghue a bottle of ginger beer. She drank it half-way, only to find a snail’s decomposed remains in the opaque bottle. Disgusted, outraged, and sickened, Donoghue successfully sued the ginger-beer brewer.
Since Donoghue v Stevenson, the legal rules protecting consumers have evolved through case law and legislation. Consumers who buy products and services have a right to sue when companies and businesses fail to observe consumer rights.
The Consumer Protection Council (CPC) is statutorily empowered to safeguard consumers from substandard and harmful products and services. The CPC, especially in recent years, has been doing a marvelous job of enlightening consumers, but effective enforcement remains a tough challenge for both CPC and consumers. The Green Snail in the Opaque Bottle will address these and related consumer-law concerns. The faculty includes judges, practitioners, and the academia.
